Watching the television program COPS, you’d come to the conclusion cigarette smoking is an integral part of crime. Suspects are routinely asked to put out their cigarettes. Handcuffed suspects quite often get into discussions on if they can smoke in the squad car, or demand their cigarettes be retrieved for them.
Smokers account for between five and 10 percent of the U.S. population, but in prisons and jails, the figure inflates to about 50 percent.
At one time smoking was considered to cool. Or if you smoked, you were considered a tough guy. Nobody would mess with you. So I am assuming the connection between the two is, criminals smoke as a form of showing their toughness. Being cool to their buddies.
The reason I first started, I wanted to be like my sister whop smoked, and most of my friends smoked too, so it was only natural that I smoked too. It was "cool" thing to do. Only difference is, none of us committed any crimes. We never considered ourselves tough. But we were girls though, so maybe it”s different for us.
I would suggest that the common factor here is intelligence.
People who smoke are idiots.
Criminals are idiots.

I should wait for some good hard research before I open my mouth on this. It is an interesting question though. Maybe smoker’s, like criminals, have a tendency to be anti-establishment, they like to rebel against what it means to be good and healthy.

smokers account for about 20% of the population
the only numbers I could find about smokers in prisons had to do with marijauna…. but that could be your answer right there…. 49% of the prison population are jailed for drug offenses.
cigarette smoking has nothing to do with criminal behavior.

Not too many years ago, our city counsel ruled that local cops can no longer smoke in their squad cars. This affected a very high percentage of our police force. Cops and criminals — is there any connection there?
As far as smokers lacking intelligence, I don’t think there’s any hard evidence there. It has more to do with the popular mindset or "zeitgeist" — if you will … When I was at the university (way back in the day), most of my professors smoked. And a lot of these fellows were gifted with superior intellects.
I suspect that criminals are less compliant than the general population. And their smoking adds to the tax base (unless they’re stealing their smokes).

Let me tell you where that criminal factor is, it’s all those lawyers who made out like bandits with that huge law suite brought against the tobacco companies then those politicians who when the got those settlements spent it for everything other than what it was intended for. For those who gloat over the fact, you will love it when they get to the guns, booze and god knows what else.
